A pool company hit my house during excavation. What legal action can I take?
My neighbors are putting in a pool and during the excavation, a backhoe hit our home and has caused some damage to our roofline and eaves of the house. I have contacted the pool company and they are not being very helpful other than saying they will fix it. I have contacted a general Contractor to provide them an esitmate but wanted to know what other leagal recourse can I take because the pool company and the excavation company are not being very responsive or attentive. it took them over 24 hours to call us and I had to demand to speak to someone. Thanks!
Need to add that i ahve contacted my home owners insurance and they said that its in the pool company's hands since they are most likely bonded/insured etc. Which they are... just taking forever to call me back, I have to call them, no remorse and the excavation person who hit my house hung up on me. Thanks!

.....call the police and have a report itemized and filed
....then in 72 hours, you can pro'lly get a copy
....in the meantime, call the pool company's insurance company and ask to file a claim for repairs.......
.....if the damage is so severe that further damages are occurring by not repairing the situation ....make that know to the insurance
.....just be nice to them, ok? be a little cooperative with that insurance, cuz they will likely work with you, oh yeah!
(.....unless you are sueing for absurd reasons, of course, then they actually have to protect their interests too)....so, don't feel pressured, unless there is a 'need' to turn up the pressure
....but be firm, and state that you want your house made perfect again!!!!!ASAP! as in send af...rick....ing adjuster by right ....fricking theis week! or you estimate that you must file a claim in civil court for dmaages!....that is usually about $35 and takes few months but, cannot be avoided by the insurance to attend.....and likely they will send someone your way real quick....bottom line, theor attorneys never have to leave their cushy offices, unless you file in county small claims...heheheh, then the attorneys do need to get up off the soft chair and get a liitle sweaty walking over to the justice center for their lovely day in court (which, in all fairness should have been avoided, by cooperatiing with you in the first place).....so, it it goes to county then always always always demand triple.....and do not settle for less.....that is the price of obstenance and delay!
